SB 249 Pulled From Committee
NSSF Thanks All Gun Owners

We just learned that in response to overwhelming grass roots opposition from law abiding gun owners and California's firearms industry members SB 249 has been pulled from Assembly Appropriations Committee hearing calendar for Thursday, August 16th. This means that the bill is dead for the year! Congratulations to everyone who responded to our legislative alerts and radio ad and called their California state legislators to oppose SB 249 which would have resulted in the unconstitutional confiscation of lawfully purchased rifles that are fully complaint with California's draconian firearms laws. Without your efforts this victory would not have been possible.

NSSF also commends the California legislature for recognizing that SB 249 was hastily conceived, and that the legislature has not had an opportunity to fully consider all of the policy implications and impacts the bill would have had, including the severe fiscal impact it would have had on the state's budget and the serious constitutional problems with the legislation.

It is not dead! According to the NRA and Calguns foundation it is set to be heard as the 5th item thurs. please keep the pressure on. If it is in fact dead, let's keep beating the dead hora till we know for sure.

Cal-FFL, Calguns Foundation opposition letters cited in official Committee analysis that may be the final straw in breaking SB 249

SAN CARLOS, CA, AND MADERA, CA – In spite of bill author Senator Leland Yee’s many assurances to the contrary, even the Assembly Appropriations Committee legislative analysis found that the SB 249 gun ban presents California taxpayers with significant cost impacts.
 
The analysis determined that, among other major costs, SB 249 would impose “one-time special fund (Dealer Record of Sale Fund- DROS) costs, likely in excess of $200,000 (the AG's office estimates about $400,000), for the AG to conform existing regulations regarding the definition of assault weapon to the definition of detachable magazine proposed by this bill.”
 
Implicit in the Committee’s analysis is that SB 249 is a material legislative change to the Penal Code, which would require new DOJ regulations.  Senator Yee and his staff have spent considerable time representing SB 249 to be a “clarification of existing law.”  We now have further evidence in the Legislative record supporting our argument that SB 249 would harm California gun owners by creating an entirely new standard for “detachable magazine” firearms.
 
Up-to-the-minute information acquired by Cal-FFL lobbyist Matt Gray of Capital Alliance and Cal-FFL president Brandon Combs suggests that, while SB 249 may not succeed in passing the Appropriations Committee due to the substantial costs issues, it is premature to consider the bill a non-threat to gun rights.
 
“SB 249 has been proven to be an outrageous attack on hundreds of millions of dollars of legal private property and law-abiding gun owners.  We’re encouraged that the Appropriation Committee’s analysis has affirmed our view that California simply cannot afford Senator Yee’s misguided bill,” said Combs.  “We urge all of our members and supporters to continue vigorously opposing SB 249 by calling the members of the Appropriations Committee and using the Take Action tools at our StopSB249.org campaign website.”

Not to be outdone by Wes at Ten Percent Firearms, Jeff #2 at ["the infamous"] PRK Arms (Fresno) created another fantastic YouTube video on SB 249-compliant firearms, this time AK-47 platform guns.

We wonder how leg. staffers reacted to Ten Percent's ad for SB249guns.com in the Sacramento 'insider's daily news mag' Capitol Morning Report? (Look under 'Items for Sale'.)

We're still impressed by how many people have found out about Stop SB 249 and Sen. Yee's gun ban through circle track racer Chris Lambert's #50 Stop SB 249 car.

Ladies, Gentlemen, and Lobbyists: (I know you are all reading this) 

What the above referenced "Assembly Rule" means is EXACTLY what it says. BTW, today is Aug. 15. It is not Aug. 17 yet.

It doesn't say that until that time (Aug. 17), they can't or won't change their mind about proceeding with a bill (SB249) that they are considering dropping. So, IF SB249 hasn't passed out of the Assembly Appropriations Committee by the end of business on Aug.17, we can PRESUME that it is dead for this session, which ends at Midnight on Aug. 31.

I clearly and purposefully say PRESUME because of a little tactic that is used in the Capitol called the RULE WAIVER. Yes, a RULE WAIVER. It has been used against us in the past and no doubt we will see it again from time-to-time.

Now, you understand when the NRA (usually Ed Worley or myself) tells you that THERE ARE NO RULES IN THE CAPITOL!!! We mean it.

Loophole will continue to put public at risk, undermines state’s assault weapon law
 
SACRAMENTO – Despite overwhelming support from gun control advocates, the California Nurses Association, the California Medical Association, and California Attorney General Kamala Harris, the Assembly Appropriations Committee has decided to hold a bill that would have closed a major loophole in the state’s assault weapon ban.
 
SB 249, authored by Senator Leland Yee (D-San Francisco/San Mateo) – which had earlier been approved in the Assembly Public Safety Committee – was expected to receive a hearing tomorrow and be approved by the Appropriations Committee.
 
SB 249 would have prohibited assault weapons with pistol grips, telescoping stock, or certain other features from having devices known as “bullet buttons” and “mag magnets,” which allow semi-automatic weapons to be easily reloaded with multiple rounds of ammunition.
 
“I am deeply disappointed that the bill is being held by the Appropriations Committee,” said Yee. “My greatest fear is that another senseless act of violence will happen before the loophole is closed. Despite the gun lobby’s efforts to derail common sense legislation, I will not give up this fight.”
 
“When California enacted our assault weapon law there was no intention of allowing such easily changeable magazines on military style weapons,” said Yee. “It is imperative that we close this loophole as soon as possible, either through legislation or new regulations at the Department of Justice.”
 
“We must stop unscrupulous gun manufacturers from circumventing California’s Assault Weapons Ban by modifying them with ‘bullet buttons,’” said Amanda Wilcox, Legislation and Policy Chair for the California Brady Campaign. “In California, you can now buy the ‘bullet button’ version of the AR-15 used by the Aurora shooter to gun down 70 people in a movie theater.”

A last-minute proposal to restrict assault rifles in California in the wake of mass shootings in Colorado and Wisconsin has been shelved for the year by state lawmakers.
 
The measure would have prohibited semi-automatic weapons from having devices that allow them to be easily reloaded with multiple rounds of ammunition, but it had become the target of an intense lobbying campaign, including radio ads, by gun groups who said it would result in legal owners losing their firearms.
 
Sen. Leland Yee (D-San Francisco) said that his proposal would have closed a loophole in California’s strict gun law and that he is "deeply disappointed" to have been notified that it will not be heard by the Assembly Appropriations Committee by Thursday’s deadline.
 
“My greatest fear is that another senseless act of violence will happen before the loophole is closed," Yee said in a statement. "When California enacted our assault weapon law there was no intention of allowing such easily changeable magazines on military-style weapons."
 
Yee said he would explore alternatives including the possibility of the state Department of Justice adopting new regulations. State Atty. Gen. Kamala Harris had endorsed his bill.
 
The bill was shelved by the committee because it is a significant change in law introduced in the last month of the session without going through normal policy committees for public input, according to Geoff Long, chief consultant for the panel. "It has nothing to do with politics,'' Long said.

Senate Bill 249, California's worst gun ban/confiscation bill in twenty years, has been removed from this Thursday’s state Assembly Appropriations Committee agenda.  Please continue to call AND e-mail the members of the state Assembly Appropriations Committee to ensure this bill stays off the committee agenda.  In addition to contacting members of the Assembly Appropriations committee, please also contact your Assemblyman and state Senator in opposition to SB 249.

SB 249 failed passage today, August 16, in the Assembly Appropriations Committee! There have been several rumors in the past few days about the fate of SB 249. This time it's true - SB 249 did not survive the scheduled hearing yesterday.
 
BUT...it is not over until it is over. CRPA and NRA will continue to be on the alert until midnight on August 31, the end of the 2011/2012 legislative session. Up until that time, a rule waiver could be granted to bring SB 249 back for reconsideration. We do not anticipate that will occur. Nevertheless, SB 249 needs to be watched closely until adjournment of the legislative session at midnight on the 31st.
 
You made the difference! THANK YOU for making your voice heard LOUD AND CLEAR down at the capitol. Your phone calls, e-mails, and letters flooded the legislative offices and got the message across! THANK YOU for your outstanding efforts and support for the Second Amendment.
